Terms of Service
Last updated: October 30, 2026
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Merchant", "you", or "your") and DataTip ("Company", "we", "us", or "our"), governing your access to and use of the VISO virtual try-on application ("Service") available through the Shopify App Store.
By installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not install or use the Service.
You represent that you have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent. If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity.
2. Service Description
VISO is an AI-powered virtual try-on application designed for Shopify merchants. The Service enables your customers to visualize how clothing and apparel items may look on them by uploading a photo and selecting a product from your store. The Service processes these inputs through artificial intelligence models to generate a composite image.
The Service includes, but is not limited to, the following features:
- Virtual Try-On: AI-generated visualization of a garment on a customer-provided photo.
- Before/After Comparison: Interactive comparison slider allowing customers to view original and try-on images side by side.
- Social Sharing: Functionality for customers to share their try-on results via supported platforms.
- Analytics Dashboard: Insights and usage data accessible through the Shopify admin panel.
- Multi-Language Support: The storefront widget is available in multiple languages.
We reserve the right to modify, update, or discontinue any feature of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
3. Account & Credits
3.1 Account Registration
To use the Service, you must have an active Shopify store and install the VISO app through the Shopify App Store. Your account is created automatically upon installation and is linked to your Shopify store credentials. You are responsible for maintaining the security of your account and for all activities that occur under it.
3.2 Subscription Plans
The Service is offered under the following plans. Paid plans are billed monthly or annually through Shopify; annual billing costs 10 times the monthly price:
- Free: 10 credits per month at no cost.
- Starter: 120 credits per month for $19/month.
- Growth: 400 credits per month for $49/month.
- Pro: 900 credits per month for $99/month.
- Enterprise: 2,400 credits per month for $249/month.
All paid subscriptions are processed through Shopify Billing. Pricing is subject to change with reasonable prior notice.
3.3 Credit System
The Service operates on a credit-based usage model:
- Each try-on consumes 1 credit.
- Monthly credits included with your plan reset at the start of each calendar month. Unused monthly credits do not carry over.
- Bonus credits (promotional or purchased separately) never expire and are consumed only after monthly credits have been exhausted.
- Optional overage: On paid monthly plans you may opt in to capped, pay-as-you-go overage. Try-ons beyond your monthly credits are billed through Shopify at $0.15 per try-on, up to a default cap of $50 per month. Overage is disabled by default and applies only when you explicitly enable it; you can disable it again at any time.
When your monthly credits are depleted, you can enable optional pay-as-you-go overage (on paid monthly plans), purchase additional credit packs, upgrade your plan, or wait until your monthly credits reset at the start of the next calendar month.
3.4 Billing & Refunds
All charges are processed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your payment method on file. Refunds are handled in accordance with Shopify's policies and at our reasonable discretion. Credits consumed for completed try-on generations are non-refundable.
4. Acceptable Use
You agree to use the Service solely for its intended commercial purpose and in compliance with all applicable laws and regulations. You shall not:
- Upload, transmit, or process any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Upload images of minors or any content depicting individuals without their express consent.
- Use the Service to generate content that could be considered deceptive, fraudulent, or misleading to consumers.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Service.
- Circumvent, disable, or interfere with any security, rate-limiting, or access-control features of the Service.
- Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable usage or places undue burden on our infrastructure.
- Resell, sublicense, or redistribute access to the Service or its outputs to third parties outside of your Shopify store.
- Use the Service in any manner that violates the Shopify App Store terms, Shopify's API terms, or any other applicable platform policies.
We reserve the right to suspend or terminate your access to the Service if we reasonably determine that you are in violation of these acceptable use provisions.
5. AI-Generated Content
Important Disclaimer: The Service uses artificial intelligence models to generate virtual try-on images. AI-generated results are approximations and are not guaranteed to be perfectly accurate representations of how a garment will look on a specific individual. Results may vary depending on image quality, lighting, garment type, body positioning, and other factors. The try-on images are intended as a visual aid and should not be considered a substitute for accurate product descriptions, sizing guides, or the customer's own judgment.
You acknowledge and agree that:
- AI-generated images are approximations and may not precisely reflect the color, fit, texture, or drape of actual garments.
- Results depend on the quality and characteristics of the input images provided by the customer and the product images from your store.
- The Service may provide AI-generated size suggestions (Size Advisor). These are estimates, are not guaranteed, and should not be the sole basis for a purchase decision.
- We do not warrant that AI-generated content will be free from artifacts, distortions, or inaccuracies.
- You are solely responsible for ensuring that AI-generated content displayed on your store complies with applicable consumer protection and advertising standards in your jurisdiction.
6. Intellectual Property
6.1 Our Intellectual Property
The Service, including its software, algorithms, user interface, design, documentation, and all associated intellectual property, is and remains the exclusive property of DataTip and its licensors. These Terms do not grant you any ownership interest in the Service. All rights not expressly granted herein are reserved.
6.2 Your Content
You retain full ownership of all product images, store content, and other materials you provide through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you. We do not claim any ownership rights over Your Content.
6.3 Customer-Uploaded Content
Photos uploaded by your customers for the purpose of virtual try-on are processed in real time and are not stored permanently on our servers beyond what is necessary to deliver the try-on result. You are responsible for informing your customers about the use of the Service and ensuring their consent in accordance with your privacy policy and applicable data protection regulations.
6.4 Generated Output
You are granted a non-exclusive, worldwide license to use, display, and distribute the AI-generated try-on images produced by the Service in connection with the operation of your Shopify store. This license is valid for the duration of your active subscription.
6.5 Your Business Independence
Nothing in these Terms restricts your ability to operate your business, use competing or alternative services, develop your own solutions, or otherwise conduct your commercial activities as you see fit. These Terms do not impose any exclusivity or non-compete obligations on you.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected in any specific timeframe.
- In no event shall DataTip, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
- Our total aggregate liability for any claims arising under or in connection with these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, the limitations set forth above shall apply to the fullest extent permitted by applicable law.
8. Termination
8.1 Termination by You
You may terminate your use of the Service at any time by uninstalling the VISO app from your Shopify store. Upon uninstallation, your subscription will be cancelled, and you will not be charged for subsequent billing periods. Any unused monthly credits at the time of termination are forfeited and non-refundable.
8.2 Termination by Us
We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. Grounds for termination include, but are not limited to:
- Violation of these Terms or the Acceptable Use policy.
- Non-payment of applicable fees.
- Conduct that we reasonably determine is harmful to us, other users, or third parties.
- Extended inactivity or non-use of the Service.
- Discontinuation of the Service or any material part thereof.
8.3 Effect of Termination
Upon termination, your right to access and use the Service ceases immediately. Sections of these Terms that by their nature are intended to survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) shall remain in full force and effect.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where practicable, by providing notice through the Service or via email. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed of any updates. If you do not agree to the modified Terms, you should discontinue your use of the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of Denmark, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Copenhagen, Denmark.
If you are a consumer located within the European Economic Area (EEA), you may also be entitled to use the European Commission's Online Dispute Resolution platform.

Annex: Data Processing Addendum
This Annex forms part of these Terms and is the data processing agreement under Article 28 of the EU General Data Protection Regulation (GDPR) and equivalent laws. For personal data of your store's shoppers that VISO processes on your behalf ("Shopper Data"), you are the controller and DataTip is the processor.
- Subject matter and duration: Processing Shopper Data to provide virtual try-on, Size Advisor, email capture and analytics features, for as long as the VISO app is installed on your store and until the data is deleted as described below.
- Types of data and data subjects: Shoppers who use VISO in your store. Data may include uploaded photographs, generated try-on images, sizes, body measurements and fit preferences entered by the shopper, Size Advisor chats, email addresses left with marketing consent, a pseudonymous visitor identifier, device and interaction data, and order attribution data (order ID and amounts, no customer contact details). The full description is in our Privacy Policy.
- Instructions: We process Shopper Data only on your documented instructions, which are these Terms and your settings in the VISO app, unless the law requires otherwise; in that case we will inform you before processing unless the law prohibits it. When you turn on email capture, you instruct us to send each shopper who leaves an email a confirmation email on your store's behalf and to delete emails not confirmed within 7 days. If you turn on saving leads to Shopify customers, you also instruct us to create or update a customer in your store for each confirmed email, subscribed with confirmed opt-in unless that customer has unsubscribed, using the customer access you grant in Shopify. Those customer records are then yours to manage in Shopify.
- Confidentiality: Everyone we authorize to process Shopper Data is bound by confidentiality obligations.
- Security: We apply appropriate technical and organizational measures, including TLS encryption in transit, encryption at rest, access controls with least privilege, signed and verified requests from Shopify, and automatic deletion of photos and results on fixed schedules.
- Sub-processors: You authorize us to use the sub-processors listed in section 6 of our Privacy Policy. We bind each sub-processor to data protection obligations no less protective than this Annex and remain responsible for them. We announce changes by updating the Privacy Policy; you may object to a change by contacting us, and if we cannot resolve the objection, you may stop using the Service by uninstalling the app.
- International transfers: Where Shopper Data is transferred outside the EEA, we rely on an adequacy decision or the EU Standard Contractual Clauses.
- Assistance: We help you respond to shopper requests to access or delete their data. Shopify's customer data request and erasure webhooks are handled automatically. We also assist you, where relevant, with data protection impact assessments and consultations with supervisory authorities.
- Personal data breaches: We notify you without undue delay after becoming aware of a personal data breach affecting Shopper Data and give you the information you need to meet your own notification obligations.
- Deletion at the end of the Service: When you uninstall VISO, your store's images are removed straight away, and all Shopper Data is deleted when Shopify sends its shop-data erasure request (about 48 hours after uninstall), unless the law requires us to keep it.
- Audits: On reasonable request, we provide the information necessary to demonstrate compliance with this Annex and allow audits by you or an auditor you appoint, subject to reasonable notice and confidentiality.
- Your responsibilities: You are responsible for having a lawful basis for the processing, for your store's privacy notice and cookie banner, and for any consent your store needs to collect.
